General Terms and Conditions (AGB)

Please read the following General Terms and Conditions (GTC) carefully before placing an order.
When you place an order in the Holm AG webshop, you accept the following GTC in full.
If you have any questions about these GTC, please contact us at web@holmsweetholm.com before placing an order. The following GTC may be amended at any time.

Scope of application

The following General Terms and Conditions (GTC) Webshop of Holm AG (hereinafter referred to as holm°) as seller and you as customer apply to all orders from the holm° Webshop range in the version valid at the time of the order.

These GTC do not apply to purchases or orders made in the holm° store.

Purchase contracts concerning exhibition items (sale items at reduced prices) are also part of these GTC, but with the following restrictions:

  • Collection / delivery:
    • The goods must be collected unless holm° agrees to (chargeable) delivery.
    • holm° decides whether the collection can take place at any time during opening hours or whether a collection date is agreed.
    • holm° does not provide any packaging material.
    • holm° does not provide carrying assistance when loading the goods into the customer’s vehicle, unless the customer requests carrying assistance prior to collection. The carrying assistance can be booked with one or two people and is subject to a charge.
  • The voluntary right of return does not apply.
  • Warranty for defects and guarantee: This does not apply.

Orders in the webshop are generally only possible for persons or companies who are resident or domiciled in Switzerland and who, if they decide to have the goods shipped, provide a delivery address in Switzerland. We are happy to accept inquiries from persons or companies from abroad who are nevertheless interested in a product – please contact us at web@holmsweetholm.com. In this case, holm° will decide whether delivery abroad is possible and which points of these GTC may change.

Order process

By completing payment, you submit a binding offer to purchase the goods in the shopping cart and agree to the validity of these GTC. The order confirmation sent automatically to the e-mail address provided when placing the order documents that your order has been received by holm°, but does not yet constitute acceptance of the offer. The e-mail will again list all items ordered and any shipping costs.
If you do not receive an e-mail, it could be that you entered the e-mail address incorrectly when placing the order or that the e-mail ended up in your spam folder. If not, please contact us at web@holmsweetholm.com.

A contract is only concluded when holm° sends an e-mail with information on shipping, collection or the delivery deadline for the ordered goods, but at the latest when the ordered goods or the collection notification are sent.

If the ordered goods are not available, holm° reserves the right not to accept the offer, so that no contract is concluded. You will be informed of this by e-mail. Payments made for the ordered goods will be refunded in this case.

If only part of the ordered goods are available, holm° reserves the right to accept the offer for only part of the goods, so that a contract is only concluded for this part. You will be informed of this by e-mail.
Payments already made for the other part of the goods will be refunded in this case.

Should it transpire after conclusion of the contract that the ordered goods cannot be delivered either in part or in full as a result of force majeure or for reasons for which holm° is not responsible, holm° is entitled to withdraw from the contract in whole or in part. You will be informed of this by e-mail. Payments already made for the corresponding goods will be refunded either in full (in the event of complete withdrawal) or in relation to the undeliverable goods (in the event of partial withdrawal).
It is not possible to assert any further claims.

Product descriptions, images and features

We pay great attention to the selection of images and the product descriptions. For technical reasons, however, the images in the webshop may not be perfect images of the products. In particular, items made from natural materials such as wood, stone or wool are always unique and differ from the images shown.

Prices and payment

All prices in the holm° webshop are quoted in Swiss francs (CHF) and are inclusive of VAT and exclusive of shipping costs. The actual shipping costs are displayed before the order is completed. Holm° expressly reserves the right to adjust the prices stated online at any time without prior notice and without further explanation. Prices are calculated at the time the order is placed on the website.

The following payment options are available:

  • PayPal: Payments are processed via PayPal’s secure payment server. It is possible to pay with the following credit cards: Mastercard, Visa, American Express and Discover.
  • Credit cards: Payment with Mastercard, Visa, American Express, Discover, Diners Club, JCB. Payment is processed via the online payment service Stripe.

Delivery, collection and delivery times

If you have decided to have the goods shipped, you will be notified by e-mail as soon as the collection of the goods from the carrier has been arranged. The risk of the goods is transferred to you when the goods are handed over to the carrier. The goods are insured by holm° against transport damage if the value of the goods exceeds the carrier’s maximum liability limit. Items that we have in stock will be delivered to you within 3-5 working days. If an item is not in stock, its delivery time can be seen in the product details in the webshop. The delivery times stated are approximate and non-binding. Please note that delivery times may be longer in the event of high demand and that we have no influence on delays in transportation, at customs or due to company vacations at suppliers or changes in their production planning. We will inform you of any foreseeable delays. If the specified dispatch or collection period is exceeded by more than 50%, you are entitled to withdraw from the contract after the expiry of a grace period of at least 10 days set by you in writing with regard to the goods not dispatched or not ready for collection. Any payments already made for the goods in question will be refunded in this case. It is not possible to assert any further claims.

holm° ships items up to a certain size and weight with Swiss Post. For all larger or heavier items, holm° uses a logistics partner at its own discretion or delivers with its own delivery service.

Deliveries by forwarding agents are carried out free kerbside. Such deliveries require personal acceptance of the goods on the delivery day communicated in advance. You are responsible for the transportation of the goods from the place of unloading to the place of use.

You are obliged to accept the shipment. If a consignment proves to be undeliverable and the goods are returned to holm° by the carrier, holm° reserves the right to waive subsequent fulfillment of its obligations with regard to the goods not accepted without setting a grace period. holm° is also entitled to demand compensation for non-fulfillment of the contract. The customer has no voluntary right to return the unaccepted goods.

All consignments are only delivered against signature.

Delivery is generally made as a complete delivery, although holm° reserves the right to make partial deliveries at its own discretion. If items are ordered with different delivery periods, the longest delivery period is generally relevant for the entire order. If, in such a case, you would like to receive the items with shorter delivery times in advance, please place a separate order for these.

If you have decided to collect the goods, you will be notified by e-mail as soon as the items are ready for collection. You can then collect them at any time during the current opening hours. The collection notification and a photo ID issued by an authority (identity card, driver’s license, passport, etc.) must be presented. The goods must be collected within four weeks of receipt of the collection notification. If items are ordered with different delivery times, you will be notified accordingly and partial collections are possible.

Shipping / delivery costs

The delivery costs depend on the shipping method used to deliver the total order. The corresponding shipping costs are displayed when the order is completed.

If you order several items, the flat-rate shipping costs will be determined on the basis of the total order.
The maximum shipping costs when ordering several items are CHF 200.

Complaints

In order to safeguard claims against the carrier and/or the insurance company, you must check the goods for integrity and completeness upon acceptance of the shipment. In the event of externally recognizable transport damage or differences in quantity, you must make a precise and detailed reservation with the carrier. Any transport damage or differences in quantity that are not externally visible must be reported to holm° by e-mail to web@holmsweetholm.com immediately, but within 5 days at the latest. If the shipment was delivered to you by Swiss Post, you must also visit the nearest post office within 8 days of delivery to report the damage. To enable a damage report to be drawn up, please bring the consignment with the packaging to the post office.

By unconditional acceptance (in the case of externally recognizable transport damage or differences in quantity) or after expiry of the five-day period (in the case of externally unrecognizable transport damage or differences in quantity), the claim against the carrier and/or the insurance company is forfeited.

Voluntary right of return

You can return all items except made-to-order items within 7 days of receipt. Please check the product details in the webshop to find out whether the item in question is a made-to-order item. Made-to-order items are ordered by holm° from suppliers on a customer-specific basis and therefore cannot be returned.

Before returning anything, please contact web@holmsweetholm.com. Please note that the items must be in their original packaging and all labels and brochures must be enclosed, all in perfect condition. Among other things, no packaging may have been cut open or seals/labels broken.

To avoid damage in transit when returning goods, please use the packaging in which they were sent to you. The return transport or return shipment is at your expense and risk. You are also welcome to return the items to our store if you prefer. As soon as we have received the goods, we will check whether the above-mentioned conditions for a return and refund are met. If this is the case, we will issue a refund through PayPal or Stripe. Only the price of the returned goods paid when the order was placed will be refunded; any shipping costs paid when the order was placed will not be refunded.

Guarantee

Holm° works with manufacturers who meet high quality standards, which is why warranty claims are rare.
If you have a warranty issue, please contact holm° at web@holmsweetholm.com. The warranty period for material and construction is two years, unless the manufacturer grants a longer warranty period. Damage caused by improper use or fault on the part of the customer is excluded. Defects covered by the guarantee clause must be reported in writing within the guarantee period. Excluded from the guarantee are glass, fabric, leather, stone, lacquer and veneer cracks. holm° does not guarantee light fastness.
Please always observe the enclosed instructions for use and care. Holm° is free to decide whether a justified defect is remedied by repair or replacement. Further claims are excluded.

Applicable law and place of jurisdiction

This webshop is operated in Switzerland; Swiss law applies. The application of the provisions of the Vienna Sales Convention (“United Nations Convention on Contracts for the International Sale of Goods”) is expressly excluded. The place of jurisdiction is Zurich.
