Terms & conditions of Holm AG's web shop

 

Please read this carefully before placing an order. When placing an order at Holm AG's web shop  you are accepting all of the following terms and conditions. If you have any questions regarding these terms and conditions, please contact us on web@holmsweetholm.com before placing an order. The following terms and conditions are subject to amendment at any time.

 

Scope of validity

The following general terms and conditions of Holm AG’s web shop apply for all orders of articles in Holm AG's webshop in the version that is valid at the time of order.

These terms and conditions are not valid for items, which are purchased at Holm AG’s retail shop.

Sales agreements concerning exhibition pieces (sale items at reduced prices) are also an integral part of these terms and conditions, but with the following restrictions:

  - Pick-up / delivery:

  • purchased goods must be picked up, unless holm° agrees to a delivery (subject to charge).
  • holm° decides whether the collection can take place at any time during the opening hours or whether a collection appointment must be arranged.
  • holm° shall not provide any packaging material.
  • holm° does not provide carrying assistance when loading the goods into the customer's vehicle, unless the customer requests carrying assistance before collection. The carrying assistance can be booked with one or two men and is subject to a charge.

  - Voluntary returns are not possible.

  - Guarantees for defects or warranties do not apply.

Purchases in the web shop are essentially only possible for individuals or companies domiciled in Switzerland, and with a Swiss address, should they opt for delivery. However, inquiries by individuals or companies from abroad are welcome – please contact us on web@holmsweetholm.com. In this case, Holm AG will decide if a delivery abroad is possible and which articles in the terms and conditions may apply.

 

Placing an order

When closing a purchase you declare to buy the items placed in the shopping cart and you agree with our terms and conditions. Subsequently, the automatically generated email to the email address stated in the order, confirms that your order has been registered at Holm AG, it does, however, not constitute an acceptance of that order. This email lists all items purchased as well as the delivery cost. Should you not receive an email, this might be because of an incorrectly inputted email address or it has landed in your spam folder or junk mail. If not, please contact us on web@holmsweetholm.com.

A binding contract comes into effect, once Holm AG sends an email concerning the delivery, pick-up or lead time of the purchased order or no later than the order’s dispatch or notification of collection.

Holm AG reserves the right to not accept the order, should the order not be available for supply. In this case, you will be informed by email and any payments made will be reimbursed.

Should only part of the order be available, Holm AG reserves the right to accept the order for that part only. You will be informed by email and any payment made for not available items will be reimbursed.

In case an order is not available for supply, as a result of force majeure, or due to unforeseen interference by third parties, after a contract is closed, Holm AG reserves the right to fully or partly withdraw from the contract. You will be informed by email and any payments (in case of a full withdrawal) or part of payments (in case of a partial withdrawal) will be reimbursed. No ulterior claims may be made.

 

Product descriptions, illustrations and characteristics

We take utmost care in selecting illustrations and describing products in the web shop. However, due to technology constraints, the image displayed online, might not be a perfect match to the physical product. Especially items made from natural materials like wood, stone and wool will always arrive unique and different from what is shown online.

 

Prices and payment

All prices in Holm AG’s web shop are in Swiss Francs (CHF) and includes the regulatory value added tax but excludes delivery charges. The actual delivery costs are listed in the shopping cart during the purchase process before the purchase is made. Holm AG reserves the right to change any prices without prior notice or explanation. The calculation of charges is made at the time of purchase in the web shop.

You have the following payment options:

  • PayPal: The payments are made through PayPal’s secure payment server. You may pay your purchase with the following credit cards: Mastercard, Visa, American Express and Discover.
  • Credit cards: Payment with Mastercard, Visa, American Express, Discover, Diners Club, JCB. The payments are processed by the online payment service Stripe.

 

Delivery, pick-up and lead times

In case you opted for a delivery of the purchased goods, you will receive an email notification as soon as the delivery is ready for dispatch. The risk of damage is transferred to the buyer as soon as the order is collected by the freight forwarder. Should the value exceed the freight forwarder’s limitation of liability, the order is insured against transport damage by Holm AG.

Products that are on stock will be delivered within 3-5 working days to the kerb door of your building. Should an article be out of stock, the expected delivery time is listed under each separate article in the web shop. The stated time of expected delivery is to be considered as tentative and approximate. Please note that your delivery may take longer during busy periods and that we are unable to influence delays due to shipping companies, Swiss customs, factory holidays or other changes in production schedules. Any foreseeable delay in delivery will be communicated to you. Should the lead time exceed the stipulated delivery time with more than 50%, you may withdraw, after a 10-day period of grace made in writing by you to Holm AG. Any payment concerning the order will be reimbursed. No further claims may be asserted.

Holm AG uses the Swiss Post for dispatching articles up to a certain size and weight. For all larger items or for articles that require special care, Holm AG uses a separate logistics partner or carries out the delivery with its own delivery service. Holm AG reserves the right to decide how an article is dispatched.

Deliveries will be made to the curbside of your building by a freight forwarder. It will require you to accept the delivery on the previously notified delivery day and organise the remaining transport of the order to the place of use. You are obliged to accept the delivery of the order. In case a delivery cannot be made and the order is returned to the sender, Holm AG reserves the right, without a period of grace, to waive the right to subsequent performance. Holm AG has the right to claim for damages, which occur as a result of the failure to fulfil the contract. A voluntary right to return the not accepted goods is excluded.

All parcels will require a signature on delivery. As a rule, all orders are dispatched as one delivery. However, Holm AG reserves the right to dispatch in separate deliveries, should this be necessary. In case items with different lead times are ordered, the longest lead time is valid for the whole order. Should you prefer to receive the items with shorter lead time before hand, please place a separate order.

In case you opted for a pick-up at our store, you will be notified as soon as your purchase is ready for you. A collection can be made during Holm AG’s opening hours. Please bring the notification of collection as well as a valid photo identification issued by a legal authority with you. The order must be picked up within 4 weeks of notification. Should you order articles with different lead times, you will be notified accordingly and be able to collect these at different times.

Should you order several articles, the delivery cost is only charged for the total order. If you order from different categories, the maximum delivery cost is CHF 200.

 

Complaints

In order to maintain claims against freight forwarder and/or insurance, you must examine the consignment for any damages at the time of delivery. In case of external damage to the goods or shortage you must place an exactly specified provision with the local carrier. In case of damages or shortage of goods not visible from outside, you must immediately or at the latest after 5 days, notify Holm AG by email to web@holmsweetholm.com. Should the dispatch be carried out by Swiss Post, you must make a corresponding claim at the nearest postal office within 8 days of delivery. In order to make the claim, please bring the delivered goods in its complete packaging with you.

Should you accept a delivery without reservation (in case of external damage to the packaging) or refrain from notification within 5 days (in case of internal damage or shortage) your right to claim is forfeited.

 

Voluntary returns

We will refund or exchange any item, except for made-to-order articles, that you are not happy with, when you return it within 7 days of delivery. Please inform yourself if the article you are interested in is a made-to-order item under the article in the web shop.

Before making a return, please contact web@holmsweetholm.com. Please note that the article must be in its original packaging, including any tags or booklets and in a fully saleable condition. No original packaging may be cut open nor seals or labels broken or removed.

In order to minimize damages on returned goods, please use the packaging the item arrived in for the return. The return is at your own risk and expense. You are welcome to return the goods at our store, should you prefer to.

Once we have received the returned item, we will decide whether a refund is valid. If the conditions are met, a refund will be made through PayPal or Stripe. We will only refund the price paid at the time of the order for a returned article, the cost of delivery will not be reimbursed.

 

Warranties

Holm AG selects suppliers, which hold a high standard of quality and warranties are very rarely the case. Should you have a warranty issue, please contact us on web@holmsweetholm.com. In general, warranties on materials and construction are valid for 2 years, unless the producer grants longer terms of warranty. Damages due to improper use or fault of the client, remain excluded from warranty. Claims covered by the warranty, should be made in writing within the duration of the warranty. Exempt from warranty are materials such as glass, fabric, leather, stone and fissures in lacquer and veneer. An article’s light fastness is not covered by warranty. Please always refer to any enclosed instructions of use. It is Holm AG’s decision if an eligible claim is remedied through a repair or a replacement. No ulterior claims may be asserted.

 

Applicable legislation and place of jurisdiction

This website is controlled and operated in Switzerland and its terms and conditions will be governed by Swiss law. The material provisions of the UN-Convention on Contracts for the International Sale of Goods (CISG) shall not apply. The place of jurisdiction is Zurich.
